“Ekanat” testifies in Section 112 case, “Thaksin” follows the law, not related to position

"Attawich" reveals "Ekanat" gave a statement in the 112 case, "Thaksin" performed his duty according to the law, stated that the police had a summons, not related to political positions, confident that the minister's qualifications are complete according to the constitution. Mr. Atthawich Suwannaphakdi, Legal Department of the Ruam Thai Sang Chart Party, revealed that from the case where there was news that Mr. Ekkanat Promphan, Secretary-General of the Ruam Thai Sang Chart Party, was the one who gave testimony in the 112 case of Mr. Thaksin Shinawatra and the issue of qualifications to be a minister. The Royal Thai Police have summoned Mr. Ekkanat to give a statement. Therefore, it is his legal duty to give a statement to the investigators based on the facts, not to offer to give a statement himself. Moreover, the said statement was given at the beginning of the year, not at this time, so it is not related to any position negotiations. Currently, the prosecutor has filed a lawsuit. It is in the court to d ecide according to the justice process. As for the issue of the qualifications of ministers according to the Constitution, if we look at the letters of the law, Section 15 of the Criminal Procedure Code, together with Section 145, Paragraph 1 of the Civil Procedure Code, it lays down the principle that a judgment or order is deemed to be binding on the parties in the proceedings of the court that made the judgment or order, from the date of the judgment or order until the date that the judgment or order is changed, amended, reversed or waived, if any. 'The Court of Appeals ruled on June 27, 2024, dismissing the case against Mr. Ekkanat. Based on preliminary legal considerations, this means that unless there is a Supreme Court ruling to the contrary, Mr. Ekkanat is innocent and has never been sentenced to prison before,' said Mr. Atthawich. Therefore, the issue of Mr. Ekkanat's qualifications is not a problem. In addition, there is a review process by the Office of the Cabinet Secretariat and the Office of the Council of State, which has many legal experts. It is expected that it will be clear soon. "The law is clear that Mr. Ekkanat can be a minister. I would like the new generation to be able to govern the country," said Mr. Atthawich. Source: Thai News Agency
