Prosecutors reiterate that if the accused is not indicted by October 25, the statute of limitations will expire.

The Attorney General’s spokesman clearly reiterated that if the suspects are not apprehended and indicted by 25 October, the statute of limitations will expire.

Mr. Prayut Petchkhun, spokesman for the Office of the Attorney General, added that when the media asked during the press conference about the statute of limitations for the Tak Bai dispersal case, in which there were deaths while in custody, he had checked the law and found that it complies with Section 95 of the Criminal Code, which states that in a criminal case, if the perpetrator is not prosecuted and brought to court within the time limit from the date of the offense, the statute of limitations will expire. In the second paragraph, if the perpetrator is prosecuted and brought to court, but the perpetrator escapes or is insane, and the court orders a suspension of the trial until the said time limit has passed since the date of escape or the date the court ordered a suspension of the trial, the statute of limitations will also expire.

It is equ
al to both cases that the people have filed their own lawsuits and the court has accepted the lawsuits, and in the cases where the Attorney General has ordered the lawsuits according to the announcement of the Attorney General’s spokesperson team, if the accused is not brought to file the lawsuit as a defendant in court within the statute of limitations on October 25, the case is considered to have expired.
